This Terms of Service ("TOS") is a binding agreement between you ("the user") and Netizen Networks, a company based in India. It outlines the general terms and conditions governing your use of the products and services provided by Netizen Networks (collectively referred to as the "Services"). By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree to these terms, you are not authorized to use or access the Services. All customers must review and accept the terms and conditions before signing up for any hosting plans or services offered by Netizen Networks. The company reserves the right to suspend or terminate a customer's access to any or all services at its discretion, particularly if it determines that the account has been misused.
The English version of this TOS is the official and legally binding version. Any translations provided are solely for convenience and understanding. In the event of a conflict or discrepancy, the English version will take precedence in all legal matters.
As a user of Netizen Networks' services, you agree to the following:
1.1 Your use of Netizen Networks' website and services, including any content you provide, will comply with this Terms of Service (TOS) agreement, all other applicable service agreements or policies, and all relevant local, state, national, and international laws and regulations.
1.2 You are prohibited from collecting or allowing anyone else to collect any personal or non-public information about other users without their explicit written consent.
1.3 You agree not to use Netizen Networks' websites or services in ways that:
• Are illegal or promote unlawful activities.
• Encourage or involve child exploitation or any activities related to child abuse material (CASM).
• Promote or engage in violence toward individuals, animals, property, or terrorism.
• Involve spam, unsolicited bulk email, hacking, or unauthorized breaches of computers or networks.
• Promote or facilitate prostitution or human trafficking.
• Infringe on the intellectual property rights of others.
• Violate the privacy or publicity rights of others, or breach confidentiality obligations.
• Disrupt the functionality of Netizen Networks' website or services.
• Introduce malicious software, such as viruses, worms, Trojan horses, or other harmful code that could impair the functionality of software or hardware.
• Contain false, misleading, or unsubstantiated claims about Netizen Networks or its services.
This includes, but is not limited to, distributing illegal or copyrighted materials, commercial audio or video files, misleading content, or participating in the following prohibited activities: involvement in topsites, Ponzi or pyramid schemes, prime bank programs, spam bots, gambling, mail bombers, port or IP scanners, brute force scripts, and mail harvesting.
Prohibited sales or distributions include illegal pharmaceuticals, drugs, explosives, anonymous or bulk SMS services, malware, warez, phishing materials, pirated software, high-yield investment programs, adult banner exchanges, and unauthorized streaming of copyrighted events.
1.18 Netizen Networks reserves the right to classify any content as "prohibited" if it is deemed indecent, offensive, hateful, or generally unacceptable.
1.19 You agree not to engage in deceitful, harmful, or disruptive behavior, nor to engage in activities that place an unreasonable load on Netizen Networks' infrastructure, as determined by the company.
1.20 You are not permitted to reproduce or distribute any part of the website without Netizen Networks' explicit permission.
1.21 You may not alter the website or the services it offers, including any related technologies.
1.22 You are only permitted to access Netizen Networks' content or user content as directed by Netizen Networks or through its site.
1.23 Reselling or offering the Services, including any of Netizen Networks' technologies, for commercial purposes is prohibited unless you have prior written consent from Netizen Networks.
1.24 You must not bypass, deactivate, or interfere with any security features of the website or services, including any features designed to prevent the copying of content or limit access to Netizen Networks' or user content.
1.25 You are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, storing, updating, or sharing any information that violates Netizen Network's policies or guidelines. Failure to comply may result in immediate termination of access or removal of non-compliant content.
1.26 You agree to provide valid government-issued photo identification or business identification for verification purposes upon request.
1.27 You acknowledge that Netizen Networks may contact you regarding your account, and such calls may be recorded. You consent to the recording of these conversations for legal purposes, without needing to provide explicit consent each time. Recordings may be used in legal proceedings.
1.28 By providing your phone number, you consent to receive marketing calls and text messages from Netizen Networks, which may be automated or pre-recorded. Providing this consent is not a condition of purchasing services. Standard message and data rates may apply.
1.29 Netizen Networks reserves the right to refuse, cancel, suspend, or restrict access to its website or services for any user whose account or services were previously terminated or suspended due to violations of any agreement or policy, or who has engaged in inappropriate or illegal activities while using the site or services.
1.32 If any purchase or account action is deemed fraudulent, abusive, or suspicious, Netizen Networks reserves the right to cancel services and close any related accounts. In cases of fraud, Netizen Networks may pursue legal action, and you may be held liable for losses, including legal fees. To dispute service cancellations or account closures, please contact customer care.
1.33 By purchasing any products from Netizen Networks, you confirm that you are at least 18 years of age.
Netizen Networks complies with the Digital Millennium Copyright Act (DMCA). If you believe that a hosted site is infringing on your copyrights, please report it to abuse@eglueweb.com.2.1 Any attempts to compromise, or actual compromises of, a network device belonging to Netizen Networks or any other company, individual, or entity are strictly prohibited. This includes activities such as port scanning, IP range scanning, and vulnerability scanning. Any violations or suspected violations will be thoroughly investigated and may result in immediate termination of services.
2.2 Distributed Denial of Service (DDoS) attacks targeting Netizen Networks or any attempts to initiate a DDoS attack from our servers are strictly forbidden. All violations or suspected violations will be investigated and may result in the immediate termination of services.
2.3 Hosting materials that infringe on any copyright, trademark, or service mark is strictly prohibited. This includes the storage or transmission of pirated movies, music, software, ringtones, or any other items categorized as "Warez." Authentic complaints will be investigated and may lead to service termination.
2.4 Hosting defamatory, scandalous, or private information about individuals without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights is strictly forbidden.
2.5 Any attempts to undermine or cause harm to our servers are prohibited. Netizen Networks holds no responsibility for the actions of clients' accounts. If an account abuses resources and no action is taken to cease the activity, it will be immediately deactivated without a refund.
2.6 Any website consuming what is deemed excessive CPU cycles or other resources that impact the performance of other sites may be subject to new terms (e.g., upgrade options). While we aim for 99.95% uptime, we cannot guarantee this due to regular updates and maintenance.
2.7 Disrespectful behavior towards any Netizen Networks staff member will not be tolerated. In such cases, we reserve the right to terminate services without issuing a refund.
3.1 The use of Netizen Networks' services to transmit any unsolicited commercial or bulk emails (SPAM) is strictly prohibited.
3.2 Upon notification of an alleged violation, we will initiate a comprehensive investigation, during which we may limit the customer's access to our network to prevent further breaches.
3.3 If a customer is found to have violated our SPAM policy, we reserve the right, at our sole discretion, to restrict, suspend, or terminate the offending hosting account. Additionally, we may seek civil remedies for any costs incurred during the investigation of a confirmed violation. If the violation is deemed criminal, we will report it to the appropriate law enforcement authorities.
3.4 Any customer using our services to host websites or support activities that enable spammers or cause any of our IP addresses to be listed in Spam Databases will have their account(s) immediately suspended, and a 25,000 INR administrative fee will be charged.
3.5 Accounts will not be unsuspended until the offending material is removed upon reconnection. First violations of this policy will result in a warning and a review of the account for potential termination. A second violation may result in immediate termination of the account and a 75000 INR administrative fee. Severe violations may lead to permanent account removal from our network without notice.
3.6 We maintain a zero-tolerance policy for posting messages or commercial advertisements that violate the rules or regulations of newsgroups or mailing lists. Commercial messages that comply with the newsgroup or mailing list rules or are solicited by recipients are permitted.
3.7 Hosting publicly accessible "open relay" SMTP or anonymous remailer services for any reason is strictly prohibited.
3.8 Spamming, sending unsolicited emails from our servers, or using email addresses maintained by us will result in immediate account deactivation without a refund. Netizen Networks will solely determine what constitutes a violation of this policy.
3.9 To maintain optimal server performance, we have established limits on the number of outgoing emails allowed per domain per hour. The highest plan allows for the maximum limits outlined below, with lower plans having reduced limits. Shared hosting customers can send up to 10 outgoing emails per hour, reseller accounts up to 25 emails per hour, and VPS/cloud customers up to 1000 emails per hour. Dedicated server customers can send up to 2000 emails per hour.
3.10 We do not guarantee inbox delivery of emails with any of our hosting plans. If emails are not delivered as expected, Netizen Networks is not responsible.
4.1 Netizen Networks provides a complimentary migration service to help transfer your website from your previous hosting provider to our platform. As the website owner, you are most familiar with its details, and while we will do our best to migrate your site files and data, it's your responsibility to ensure access for data retrieval and confirm the successful migration. We aim to complete the process within 72 hours, though we cannot promise specific timeframes. In some cases, we may assist with transferring emails, DNS records, and domain names, but we do not guarantee the success or continuity of these migrations.
4.2 Hosting configurations vary between providers, and some data may be stored in formats that are incompatible or proprietary, making migration difficult or impossible in certain cases.
4.3 Our free migration service is available for 30 days from the date of your account activation. Beyond this period, migration fees may apply. If needed, please contact our Transfers/Migration team by submitting a support ticket. Netizen Networks cannot be held liable for any lost or missing data during the transfer process. It is your responsibility to back up your data at all times.
4.4 Free migration services are not applicable to unmanaged hosting plans. If migration support is required for these services, additional charges will apply.
4.5 Whether for managed or unmanaged hosting, migration fees will apply if the control panels are different between providers or if manual migration is necessary.
If a customer’s account surpasses the allocated bandwidth limit, we will notify the customer. Should the customer choose not to purchase additional bandwidth or upgrade their account and continues to exceed the limit, the account will be suspended until corrective actions are taken to prevent further overages or the account is upgraded, whichever occurs first. The account will be reactivated at the beginning of next month.
The following guidelines apply to shared, reseller, and cloud hosting plans:
6.1 The storage space provided on the hosting server is solely for hosting websites and applications.
6.2 This storage should not be used to keep unnecessary files that are unrelated to your websites or applications.
6.3 It is prohibited to use this space for files that can be stored locally, website backups, FTP hosting, or demonstration purposes.
6.4 Cron jobs should not be set to run at intervals shorter than fifteen (15) minutes.
6.5 MySQL queries should not run for more than thirty (30) seconds.
6.6 You must not use more than twenty-five percent (25%) of system resources for periods longer than ninety (90) seconds at a time. Excessive resource usage may be caused by activities such as CGI scripts, FTP, PHP, HTTP, and similar processes.
7.1 It is prohibited to use a shared hosting account to resell web hosting services. If you intend to resell hosting, you must sign up for a reseller hosting plan.
7.2 Resellers are responsible for ensuring that each of their clients complies with this Agreement.
7.3 Resellers are fully accountable for providing support to their clients, including customer service, billing, and technical assistance. We are not obligated to offer direct support to the clients of resellers. Any issues faced by clients must be reported by the reseller on their behalf.
7.4 Resellers are solely responsible for all content stored or transmitted through their reseller account and for the actions of their clients. We may hold resellers accountable for any illegal or prohibited activity carried out by their clients.
7.5 The Company is not responsible for the actions or omissions of its resellers. Resellers agree to indemnify the Company against any claims brought by their clients as a result of the reseller’s actions or omissions.
7.6 The Company reserves the right to modify its Reseller plans at any time. Any changes will take effect either when publicly posted or on a future date specified by the Company.
9.1 Your use of our hosting services is at your own risk. You are responsible for maintaining and backing up all your content to ensure its availability and usability. Netizen Networks does not guarantee that we will back up any accounts or user content, and you accept the risk of any potential loss of your data.
9.2 Before restoring a backup, Netizen Networks will provide you with a screenshot of the website for your confirmation. You must verify and approve the backup before we proceed with the restoration. Once the backup is restored, it is your responsibility to ensure that it has been restored correctly. No refunds will be issued if you later claim that the restored backup does not meet your needs or expectations.
9.3 Netizen Networks will not be held liable for any loss of data under any circumstances.
9.4 For shared, cloud, and reseller hosting plans, daily backups are provided, including database backups with a retention period of 7 days. Website backups are also taken daily with 7 days retention. Please note that backups maintained by Netizen Networks do not include emails or media files.
9.5 We recommend that clients using VPS and dedicated servers consider our paid backup solutions for enhanced protection and recovery options.
9.6 Clients utilizing the cPanel Backup Manager tool should download their backups and remove them from the server. The hosting space should not be used to store backup files.
9.7 Unpaid invoices may lead to the suspension or termination of your hosting account. Your account will be restored only after the outstanding invoice is cleared, allowing you access to your data. Additionally, Netizen Networks reserves the right to set a restoration charge at our discretion.
9.8 If your account is terminated, the data associated with it will not be restored and will be considered as a new account. Failure to renew your subscription on time will incur charges on your invoice. In special cases, we may provide a new account, but this does not include restoring the previous site for free.
9.9 We will not process new orders or activate new packages for customers with an outstanding balance on their account.
To use our services, you must create an account. Upon placing your order, you may receive a username and password; however, we reserve the right to alter these details as needed. Any changes will be communicated to you via the official Netizen Networks email address. By setting up and using your account, you agree that all information provided is accurate, truthful, and complete. You are responsible for all activities associated with your account, whether or not you authorized them, so it is essential to keep your login credentials secure. Please notify us immediately if you detect any unauthorized use of your account or any security breaches.
11.1 We cannot guarantee the availability of any specific domain name you request for registration. The domain will always be registered in or transferred to your name. You should manage your domain's WHOIS information through your Netizen Networks client area, ensuring that all details are accurate. If your contact information is not kept up to date and cannot be verified, your domain may be suspended. For optimal service, we reserve the right to change the registrar of a domain at our discretion and without prior notice.
11.2 For all relevant gTLDs, you agree to our role as a Designated Agent in accordance with ICANN's Transfer Policy whenever a request is made to update the registrant contact details associated with a domain. You authorize us to approve changes to the registrant or any modifications to the registrant's details on your behalf.
11.3 Once a domain is registered, no refunds will be issued.
You may not register a domain name that closely resembles a trademarked domain or a brand name associated with similar goods or services. Attempting to register such a domain name may result in liability for trademark infringement. Examples include names like TechGiantSale.com, BestSmartphones4U.net, and GlobalFinanceCo.org.
We will send you reminders to renew your domain one month before the expiry. For failure or delay in the renewal of a domain, we are not responsible. Once a domain is renewed no refunds will be given.
